Federal Court Orders Freedom of Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The case originates in a erroneous removal to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to answer alien smuggling allegations, he was held in immigration custody.
In her decision, the judge pointed out that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
