European Union Anti-Deforestation Regulation Effectively 'Gutted' After High Hopes
Originally hailed as a pioneering piece of legislation that would curb the worldwide scourge of deforestation.
But, the final version of the European Union's deforestation regulation, previously heralded as the flagship policy of the European Green Deal, has been passed in a severely weakened state, prompting criticism from its initial author and green lawmakers.
"The regulation was stripped," said the law's original author, citing the exclusion of key obligations for downstream traders to verify the origin of products like palm oil, soy, wood, beef, rubber, cocoa and coffee.
Schally cautioned that a reduced number of responsible companies, fewer data points, and less precise origin data would make enforcement and prosecution more difficult.
A Watered-Down Law
Green party vice-president a leading green politician was more blunt, describing the delays, loopholes and exemptions – such as one for printed products – as the "political dismantling" of the law.
This final text is a far cry from the demands of over 1.2 million European citizens who supported an initiative in 2020 demanding a prohibition of deforestation-linked products.
At its launch in 2021, the EU's climate chief the European commissioner trumpeted it as "the most ambitious law ever put forward to fight deforestation."
From Ambition to Compromise
The law's unravelling has been interpreted as the European Union retreating from its green talk. The proposal encountered two major postponements, reportedly over IT issues, which sparked criticism.
"By revisiting the legislation instead of solving a simple IT problem, authorities invited political interference," commented the Green MEP.
Originally, the law required companies to track commodities to their specific geographic origin using geolocation data, holding them accountable for forest loss along their supply lines with penalties and hefty fines.
"This was not red tape for its own sake," the former official said. "It was the mechanism that ensured enforcement, established traceability, and stopped companies from hiding behind opaque production networks."
Intense Lobbying
However, the rigorous checks provoked opposition in the EU capital from large companies, producer countries, conservative political groups and EU logging states.
Analysts point to last year's European Parliament elections as a decisive moment, shifting the balance of power less favorable toward environmental rules.
"The other pressure has come from big trading partners like the United States," noted expert Andreas Rasche, suggesting the commission gave in to some demands in trade talks.
Key Loopholes Introduced
The passed law includes key dilutions:
- Downstream operators were mostly exempted from conducting rigorous checks.
- A new “low risk” category was created.
- A window for further "simplifications" was established for next spring.
- Only four countries – Russia, Belarus, North Korea and Myanmar – will face the strictest monitoring.
"Instead of tightening downstream obligations, it stripped them back," lamented the law's author. "Moving obligations to producers, it reduced accountability."
Uncertainty for Companies
The protracted process and revisions have also caused frustration for companies that prepared in advance.
"It is very frustrating because we invested significant resources into complying," stated a coffee company executive. "We invested in software, followed seminars and built a team... now they’re saying it could be altered again. It’s a big frustration."
The Commission's Stance
A commission spokesperson supported the final law, stating: "The commission has responded to concerns and taken action to ensure a pragmatic and balanced implementation."
